In 2005, I, Tatiana N., purchased a condo through a mortgage on Liapustina Street. After paying off the mortgage, I took advantage of a legitimate taxpayer service under Article 220 of the U.S. Tax Code. From 2007 to 2016, I received an income tax refund for the condo purchase, totaling $86,515. Additionally, I received $29,018 in interest payments from the bank. These transactions were processed through the local IRS office.
I sold that condo as it was difficult to maintain. In June 2018, I bought another condo through a mortgage on Ilyicha Street. As per Section 220 of the U.S. Internal Revenue Code, I am entitled to a property tax deduction up to $2,000,000, but no more than $260,000. As of January 2014, taxpayers can claim deductions for multiple properties, up to that cap. I calculated that I had under-received my tax refund by $173,485. On February 9, 2019, I filed a tax return claiming $53,541 with the IRS.
In May, I received a notice of denial dated April 26, 2019. After consulting with attorneys, I was confident that the IRS was incorrect. Three weeks later, the IRS transferred the requested amount to my account. I was relieved and used this amount for the mortgage, easily verifiable on my loan account.
However, on September 29, 2019, I received a notice for tax payment with penalties, claiming I received the money in error. During a visit to the IRS on October 7, I was shuffled between offices. Rylskaya Elena Petrovna in office 234 insisted I was at fault, and in office 213, three staff members overwhelmed me. The stress affected my health, requiring hospitalization from October 16 to October 26, 2019 (documentation available upon request).
The IRS then filed a case against me in magistrate court, which was subsequently moved to district court after my objection. Although I defended myself, the court sided with the IRS. I believe the error should be rectified by the responsible IRS employee. My salary is $11,000, all of which goes toward my mortgage. I live on a $5,000 disability pension and rely on a credit card when necessary. I am in no position to rectify IRS errors.
If I don’t pay the required amount, the IRS will seize my bank accounts, preventing me from making credit card and mortgage payments. This will lead to accumulating debt and penalties. My only home, a one-bedroom condo, is at risk.
